Introduction: These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) are intended to govern the contractual relationship between Maison Vénus (hereinafter referred to as the “Merchant”) and any person wishing to make a purchase (hereinafter referred to as the “Customer”) on the Maison Vénus website (hereinafter referred to as the “Website”). For any questions, the Customer may contact customer service at the following address: maisonvenusfrance@gmail.com.
1. Acceptance of the GTC
By using the Website or placing an order, the Customer unconditionally accepts these GTC and the Privacy Policy. Before confirming an order, the Customer must tick the box: “I acknowledge that I have read and accepted the General Terms and Conditions of Sale and the Privacy Policy.”
2. Severability of Clauses
The invalidation of any clause shall not affect the validity of the GTC as a whole.
3. Amendments to the GTC
Maison Vénus reserves the right to amend the GTC at any time. Any amendments shall take effect upon publication and shall apply to future orders.
4. Products
Products are described as accurately as possible. However, photographs and descriptions are not contractually binding. In the event that a product is unavailable, the order will be cancelled and the Customer will be informed.
5. Availability and Orders
Orders become final upon acceptance of payment. Maison Vénus reserves the right to cancel any order deemed suspicious or fraudulent. In the event of a non-compliant or abusive order, the Customer's account may be deleted.
6. Prices and Payment Terms
Prices are expressed in euros.
- For private customers established within the European Union, prices are displayed inclusive of all taxes (VAT included). The VAT rate applied is the rate in force in the country to which the order is delivered, in accordance with applicable European regulations.
- For professional customers established in another European Union Member State who have a valid intra-Community VAT number, purchases are invoiced excluding VAT, in accordance with applicable regulations. To benefit from this VAT exemption, the Customer must contact Maison Vénus before placing an order so that their account can be validated as a professional account. Otherwise, any order placed from an account that has not been validated will be invoiced including VAT. No VAT adjustment can be made after the order has been confirmed if the professional account was not previously validated by Maison Vénus.
- For customers located outside the European Union, whether private individuals or professionals, prices are displayed excluding VAT. Any customs duties, local taxes, import charges or other taxes applicable in the destination country are the sole responsibility of the Customer.
Delivery charges are indicated before final confirmation of the order.
Maison Vénus reserves the right to change its prices at any time. However, products are invoiced based on the prices applicable at the time the order is confirmed. In the event of an obvious pricing error, the Customer will be contacted and given the option to accept the corrected price or cancel the order.
All orders are payable immediately and in full at the time of ordering. No deferred payment, payment on account, payment deadline or payment after dispatch is accepted unless Maison Vénus has given prior written consent.
An order shall only be considered definitively confirmed once Maison Vénus has effectively received payment in full. Merely issuing a bank transfer order, providing proof of payment or presenting any other evidence of payment shall not constitute receipt of funds.
Preparation, processing and dispatch of products shall only take place once all amounts due have been received in full, including the price of the products, delivery charges and, where applicable, additional services.
In the event of incomplete, refused, cancelled or unreceived payment, Maison Vénus reserves the right to suspend or cancel the order and shall not dispatch any products until full payment has actually been received.
7. Delivery
Maison Vénus delivers to the countries offered when entering the delivery address on the Website. If the desired destination country is not available, the Customer is invited to contact Maison Vénus to determine whether a suitable shipping solution can be arranged.
Delivery charges are calculated automatically when the order is placed, taking into account, in particular, the destination country, weight, volume, selected delivery method and any other characteristic that may affect the shipping cost. They include, in particular, costs associated with packaging materials, protective packing, postage or transport, as well as insurance where applicable.
In the event of an obvious error affecting the amount of the delivery charges, including an error relating to the destination, weight, volume, dimensions or any other anomaly affecting the automatic calculation, Maison Vénus reserves the right to request additional delivery charges before dispatching the order. The Customer may accept or refuse these additional charges. In the event of refusal or failure to respond within a reasonable period, the order will be cancelled and any amounts already paid will be refunded in full.
Orders are only prepared and dispatched once full payment has effectively been received.
Products in stock for which full payment has been effectively received and confirmed before 2:00 p.m. will, whenever possible, be dispatched the same day, excluding weekends, public holidays and Maison Vénus closure periods. Orders for which payment is received after 2:00 p.m., or which require additional time for funds to clear, will be prepared from the following business day. During periods of high activity, orders for which the priority preparation option has been purchased will be processed first. Other orders may be prepared on the following business day.
Preparation and delivery times are provided for information purposes only. They depend, in particular, on carriers, administrative or customs formalities and any events beyond the control of Maison Vénus. They do not constitute a contractual commitment and are not guaranteed. A delivery delay shall not entitle the Customer to compensation, penalties, cancellation of the order or refusal of the goods, except where otherwise required by mandatory legal provisions.
The Customer must check the apparent condition of the products and their packaging upon receipt of the order. Any anomaly or reservation must be reported in accordance with applicable legal provisions and the terms and conditions of the relevant carrier.
Collection of Orders from the Paris Office
The Customer may choose to collect their order from the Maison Vénus office located in the 9th arrondissement of Paris, when this option is offered during checkout.
The order must be collected within a maximum period of three (3) weeks from confirmation that the order is available. Collections take place exclusively on Tuesdays, by appointment, using the booking link sent by email once the order is ready.
Certain products, particularly due to their hazardous nature, size or logistical constraints, are not eligible for collection from the Paris office. If in doubt, the Customer is invited to contact Maison Vénus before placing an order.
The office is accessible by lift. Persons with reduced mobility may request that their order be handed over on the ground floor.
If the Customer is unable to attend an appointment, they undertake to reschedule it as soon as possible.
If the order is not collected within the three (3)-week period, Maison Vénus may arrange for the order to be shipped to the address provided by the Customer, subject to prior payment of the corresponding delivery charges.
Orders Containing Special-Order Items
Where an order contains one or more items requiring specific procurement from a supplier, Maison Vénus will order such items once the order has been definitively confirmed and payment has been received in full.
The Customer will be informed by email of the estimated procurement lead time.
Whenever possible, the entire order will be shipped in a single consignment. If certain items require a longer procurement period, Maison Vénus may, at its sole discretion, partially ship the available items, with the remaining items being shipped subsequently at no additional delivery cost to the Customer.
8. Returns and Right of Withdrawal
In accordance with Articles L221-18 to L221-28 of the French Consumer Code, the Customer has a period of fourteen (14) calendar days from receipt of the order to exercise their right of withdrawal without having to provide a reason.

9. Legal Guarantees and Latent Defects
In accordance with applicable legal provisions, the Customer benefits from the legal guarantee of conformity provided for in Articles L.217-3 et seq. of the French Consumer Code, as well as the guarantee against latent defects provided for in Articles 1641 et seq. of the French Civil Code.
The Customer has a period of two (2) years from delivery of the goods to take action under the legal guarantee of conformity.
In the event of a lack of conformity, the Customer may request repair or replacement of the product. Failing this, the Customer may request a price reduction or refund under the conditions provided for by law.
The guarantee against latent defects allows the Customer to request cancellation of the sale or a reduction in the purchase price, in accordance with Article 1644 of the French Civil Code.
Any request must be sent to Maison Vénus by email or post, together with the necessary supporting documents.
10. Subscriptions
Subscriptions are personal and may not be transferred. In the event of abuse, Maison Vénus reserves the right to terminate them without notice or refund.
11. Delivery Claims
The Customer is invited to check the condition of the parcel and products immediately upon receipt.
In the event of loss, damage, a damaged parcel or any other transport-related issue, the Customer is invited to report the issue to Maison Vénus as soon as possible and, where applicable, to make the reservations required by applicable regulations with the carrier.
In accordance with Article L.133-3 of the French Commercial Code, reservations concerning apparent damage must be made to the carrier under the conditions and within the time limits provided for by applicable regulations.
These procedures facilitate the processing of the claim and are carried out without prejudice to the Customer's rights under the applicable statutory guarantees.
12. Intellectual Property
All elements of the Website are the exclusive property of Maison Vénus. Any reproduction without authorisation is prohibited.
13. Personal Data
Data is collected for internal use. The Customer may exercise their rights by contacting maisonvenusfrance@gmail.com.

14. Applicable Law and Disputes
The GTC are governed by French law. In the event of a dispute, an amicable solution will first be sought. Failing this, the French courts shall have sole jurisdiction.
15. Force Majeure
Maison Vénus cannot be held liable in the event of force majeure preventing the performance of its contractual obligations (examples: strikes, fires, breakdowns, epidemics, cyberattacks, etc.). Performance of the obligations shall be suspended for the duration of the force majeure event.
16. Refusal of Orders
Maison Vénus reserves the right to refuse or cancel any order in the event of a previous dispute with the Customer, total or partial non-payment of a previous order, fraud, attempted fraud, abuse of the right of withdrawal, abnormal returns or any other legitimate reason likely to compromise the proper fulfilment of the order.
